Traditional Negotiation. My approach is to try settle in a non-adversarial way as to avoid court. If an agreement is reached, then a separation agreement is drafted and becomes legally binding once signed by both parties.
Litigation. If an agreement cannot be reached during the traditional negotiation process, then taking the matter to court is the last resort. A lot is at risk for both parties, and seeking professional, dedicated advocacy is crucial for this process.
Collaborative Family Law. A process for settlement-oriented couples who want to avoid the devastating impact of going to court. A participation agreement is signed between both parties so that there is a promise to avoid court, and the parties meet face-to-face with their respective lawyers to reach agreement. Often a result can be reached much more quickly than proceeding through the litigation route, and usually without the hostility that litigation can foster. If you have children, you owe it to them to work out an amicable settlement with your former spouse.
